Q: Michigan Private Used Auto Sale Laws?
Anyone know what the law would be for my situation. I’m in Michigan, and I purchased a 2002 Kia Spectra from a woman who told me everything on the vehicle was great except the transmission. So, I purchased it with the expectation that the transmission needed replacing, but everthing else was fine. I got 10 minutes from the woman’s house with the car, and it lost power, it overheated, and the radiator blew about 3 minutes after I got on the highway with it. I left it on the side of the road because it wouldn’t start back up. She tells me it isn’t her problem, it’s mine. Do I have any legal recourse against her? I drove the car just 10 minutes!
A: Yes, but since it sounds like she is not cooperating I would recommend that you speak with a lawyer – at the least you should look into filing a cause of action – which you can do on your own, but it would be easier to have a lawyers help.
She made a promise to you when she sold you the car – and clearly she was not being truthful – this is fraud and breach of contract – it is horrible that she won’t cooperate, sorry to hear about your situation.

What I’m hoping to find here is perhaps someone who has experience with laws regarding used auto sales, particularly in the state of California.
I recently sold a used car (2000) to someone. The person saw a photo and description on-line, then came to see the car in person. He test-drove the car, and then decided to purchase the car.
Later that day, he claimed the car was driving roughly and that the car had front end problems. We had experienced no such thing and hence, it wasn’t in our description. He claimed a mechanic gave him an estimate of $600 to fix the struts. I offered to pay half out of kindness only, as we hadn’t had any problems with it.
He later said that wasn’t enough, and that another mechanic told him there were more problems.
I think he’s lying at this point and he’s claiming he wants to go to court. I told him he should have had the car inspected professionally if he was going to make demands for money. I simply wouldn’t have sold it to him. To me, it’s a used car… and used cars need things replaced. (I’ve bought many.)
So, regardless who is “right” here… my question is one of liability. What liability to I have for repairs after someone test-drives my car, buys it, gives me money and signs the paperwork? Specifically, if anyone has knowledge of California law, it would be very helpful.

The ad for the car did not state that any warranty was included. (I’m a private party.) I didn’t write “as-is,” but I assumed all p2p private used car sales were as-is.
A: If the vehicle was sold with no warranty, “as-is”, or “with all faults”, you have no obligations towards the buyer.

Q: Question about those used car sale events?
Have you seen those ads about used auto car events? You know they advertise that they will be in a mall parking lot, or inside your local event center? They are usually aired on TV. Well in my local town we usually have these events by the same auto dealerships in our local expo center. What they claim is that $99 will be your down payment and $99 will be your monthly payment etc. Do you think they can work with people with little or not credit? Because I need a new car and I really am not picky about the age or anything. I am 19 and I barely started working again last month, and I have two good paying jobs. So what are my chances on getting in on these special financing deals they talk about? You know $99 down and $99 per month.
I have some money for a cheap car but I suppose I should try my luck there and build my credit since I only have internet and cell phone in my name. Any advice or warnings?

Yes, you can have a $99 payement, with sufficient down payment, on a cheap enough car, and credit approval.
With no real credit established, the $99 down payment is not happening. You need some skin in the game to get car credit approved. You will also need a cosigner to get any approval whatsoever. The $99/mo payment will happen if you have a good bit of cash to put down, AND the cosigner.

I want to get as aggressive as possible selling my car. I listed it on craigslist as a start, and I am now looking for the best way to list it on other sites. Does anyone have any suggestions on the best site to list on? Which site has the most success with used auto sales?
A: Ebay is the best, but it cost $40 to list and $40 when it sells, a good free one is craigslist.org
Q: As anyone used Auto Speditions to buy a used caravan?
Auto Speditions act as a third party to sell a used touring caravan – Originally they wanted the money wiring to them before they delivered the caravan but now theyve agreed half before and half after the sale completes. You track the delivery using a tracking number on their website and normally i’d warn people away from sending money first but what if this is genuine??? People are having items repo’d all the time and sold for a pitance – has anyone else bought a caravan this way???

A: If you mean a Bill of Sale, just write up one stating the date, the vehicle description, VIN number, mileage, sale price, names and signatures of buyer and seller.
If you are thinking about selling your car to someone and accepting payments, DON’T DO IT. There are hundreds of horror stories on this answer board of people who did it, and now regret it.

A: I don’t want to ruin your sale but well its really up to the buyer to do all the researce. Once he does It might not be worth it to him unless its something rare or special. Us car will have to be converted to canadian standards as well being taxed as a import and have to be processed at us and canadian customs. The total process can take a while.

Q: I need help finding auto sales used car laws.?
My husband and I purchased a used car a few months ago. We asked for a carfax report on the vehicle and we were told that the vehicle had had no accidents. We received a post card in the mail from another dealership that would offer us top dollar for our car. We figured “Why not” we are having a little financial difficutly. Brought the car there and found out that our vehilcle was in a car accident and the value of our car is about half of what we purchased it for. What I need to find out is what can we do. The car was sold with a warranty not as is. We don’t want a vehicle that has had front end damage in the past. We never would have purchased this vehicle had we known it was in an accident. I am looking for any type of laws for this or what we can do.
A: Laws vary from state to state and it appears you were deliberately mislead. The best way to find out about car laws in your community is to talk to AAA (if you aren’t a member you should be) they are the best source for vehicle code anywhere. They will tell you what your rights are and if you have a case before you throw thousands at a lawyer. GOOD LUCK!
Q: Does the box have to be marked off on the Buyer’s Guide for a used auto purchase for it to be an as is sale?
I need a professional opinion. Me and my fiance have been searching all over. I found many sites that posted the box has to be marked either “As is” or “No Warranty”. We’re wondering because the sales rep just had him initial above the “As is” box. Would that hold up in court or do we have a case since he didn’t technically check off the box. There’s some other things he didn’t do like his math is horrible. He’s nearly $1,000 off in the balance. And he sold us gap insurance which I was told we didn’t even need. It was just something they sell to make more money on those who don’t know any different. Can you help us. Do I have any kind of case? Because if we would have had the warranty like the dealer gave to us and took away we would still have our car and be making payments. No thanks to him, we lost our job due to an infuctional vehicle, lost our car due to lack of funding and had to move out of our place. Now thankfully we’re back on our feet and have a home and new vehicle. But my fiance has bad credit and we were scammed. Any suggestions. We’re hoping they sue us soon so we can take them to a legal court room and get the money back we so deserve. Any suggestions on getting them to sue sooner?

Actually it was there fault. Within a month or so the radiator and the transmission to the car failed. I’d say that they knew about this and didn’t care. For $10,000 that’s pathetic. I now have a car I only paid $900 for. We only had to do minor repairs so far. Crossing my fingers. But I guess I will have to chuck up a loss and say I will only deal with independant people from now on. That just sickens me. And you sir, I assume from your total lack of regard and respect for the common man or woman must be a car dealer rep yourself. How do you sleep with yourself at night doing this to innocent people?
A: Initialing the box is all that’s needed. It doesn’t have to be checked off. By initialing it, the buyer states that he/she fully understands the car is being sold as-is.
Burden of proof is another thing. You’ll need to be able to prove the dealer knew about the defects and hid them from you for you to have a case against them. That is very difficult. And that’s where a lawyer comes in. You should consult with one to see if you have grounds for suing them.

Me and a friend are in the process of opening up a used auto sales business. Everything is complete and just waiting for the license to show up in the mail. However, I decided it would be nice to have a catchy slogan but cannot come up with anything. I figured with as many people we have out here in cyber land someone was bound to come up with something good. We will consider any and all responses. *Few things to note about the cars we will be selling. 500.00-5000.00 range on pricing. Trying to keep affordable cars for the average person. We also have interest in just about everything so we are thinking of telling people that we will accept just about anything for trade as long as we do not have to feed it…lol We both have full time jobs so it is not just for the money but as a hobby as well. I was looking through used car sale and found this individual dealer on Cars.com. The price seems cheaper than other cars, so I sent him an e-mail saying I am interested in. In the e-mail, I, however, showed my worry about the credibility of the transaction, and then he said,
“The sale will be managed through yahoo autos company under their vehicle purchase protection program since they offer the highest rate of safety and reliability during online transactions. They act as a neutral third party. Here is how the process works:
- you have to give me your full name and shipping address,
- I will start a transaction on yahoo autos company,
- they will send you the invoice with the payment instructions and transaction terms,
- you will send the first payment to yahoo autos trust account – half of the price,
- they will confirm me that they received and secured the funds,
- I will ship the car immediately after the first payment is received by yahoo autos company ( I will pay the shipping ),
- in two days after I will ship the car you must send the balance to yahoo autos,
- you will receive the car between 5 and 7 days from the shipping date, inspect it and if you decide to keep it they will release the funds to me ( they will send me the money ).

Is this a fraud? or is he telling the truth? I’m not so sure, because I haven’t bought a car online.

Q: Why does my credit union want to charge me sales tax for a used car loan?
I applied to my credit union for a used auto loan and was approved. They then told me I had to pay sales tax on the car for the loan amount which makes no sense to me since this transaction is between two people and doesnt involve the bank anymore than that they are financing my loan and no dealership is involved to pay a sales tax. Does this make sense to anyone or is this normal for bank to make you pay sales tax on an auto loan? My friend who I’m buying the car from is being required to come to the bank with me sign some paperwork as well. None of this makes sense.

A: You may be confused. Your state probably requires the collection of sales tax on the sale of a vehicle, and you will likely have to provide proof of the payment tax in order to register the vehicle once you purchase it. Otherwise, I don’t understand the Credit Union’s involvement.
